The court is statutorily required to monitor all guardianships and to create and supervise a program to annually visit each ward of the court pursuant to such mandate. The court recruits, trains and supervises volunteers to staff its guardianship monitoring program and to make site visits to wards under guardianship. The court is required to perform an annual review of each guardianship and make a written determination as to whether each guardianship is to be continued, whether the powers of the guardian are to be increased or decreased, whether the rights of the ward are to be further limited or restored, or whether the guardianship should be closed. This process involves approximately 1,500 guardianships annually. Before a guardianship can be granted the applicant must prove by clear and convincing evidence that the supports and services that are available to the proposed Ward that would avoid the need for the appointment of a guardian have been considered and determined not to be feasible.
