Small Claims Case

A small claims case is a lawsuit brought for the recovery of money damages, civil penalties, personal property, or other relief allowed by law. The claim can be for no more than $20,000, excluding statutory interest and court costs but including attorney fees, if any. Small claims cases are governed by Rules 500-507 of Part V of the Rules of Civil Procedure.

FORMS NEEDED:

* Indicates three copies need to be submitted

1.    Small Claims Petition*

2.    Military Affidavit* (if applicable)

PAYMENT OPTIONS:

1.    File with Justice Court 2 and serve in Tarrant County

  • Fees
  • $54 filing fee
  • $75 Constable fee for each person being served

2.    File with Justice Court 2 and serve outside Tarrant County

  • The citation and accompanying documents will be sent directly to the Plaintiff. It is the Plaintiff's responsibility to identify the proper service agency and ensure that all documents are submitted to the agency with payment.
