Redaction
The Texas Public Information Act in Texas Government Code chapter 552 makes some material excepted from public release or confidential. By agreeing to redactions and withholdings, you are allowing Tarrant County to exclude information from your request which the Public Information Act either excepts from release or deems confidential. Below is a list of the exceptions to release you are agreeing to. But you may choose to not agree to any of these by specifically stating so in the box provided.
Law enforcement and prosecutorial information under Government Code section 552.108
- You agree to allow Tarrant County to withhold information held by a law enforcement agency or prosecutor that deals with the detection, investigation, or prosecution of crime if the investigation or prosecution is pending and active and the release of the documents would adversely impact the case.
- You agree to allow Tarrant County to withhold information relating to a criminal prosecution if it is prepared by an attorney representing the state in anticipation of or in the course of preparing for criminal litigation or reflects the mental impressions or legal reasoning of an attorney representing the state.
- This information may be withheld pursuant to Government Code section 552.108(a)(1), (a)(4), (b)(1) & (b)(3).
Dates of birth of members of the public
- You agree to allow Tarrant County to withhold dates of birth of members of the public.
- This information may be withheld pursuant to Government Code section 552.101 in conjunction with comm-law privacy.
Medical records and information
- You agree to allow Tarrant County to withhold records and information which constitute medical records (including from emergency medical services personnel), contain information relating to a medical condition or diagnosis, or information disclosing a mental illnesses.
- This information may be withheld pursuant to Government Code section 552.101 in conjunction with constitutional and common-law privacy, Occupations Code section 159.002, and Health and Safety Code section 773.091.
Child abuse and neglect records
- You agree to allow Tarrant County to withhold records relating to child abuse and neglect.
- This information may be withheld pursuant to Government Code section 552.101 and Family Code section 261.201.
Juvenile law enforcement records
- You agree to allow Tarrant County to withhold law enforcement records concerning a child who is alleged to have engaged in delinquent conduct or conduct indicating a need for supervision.
- This information may be withheld pursuant to Government Code section 552.101 and Family Code section 58.008.
Identifying information of sexual assault or sexual harassment victims
You agree to allow Tarrant County to withhold the names, addresses, phone numbers, workplace information, family information, and any other piece of identifying information of victims or alleged victims of sexual assault or sexual harassment.- This information may be withheld under Government Code section 552.101 in conjunction with common-law privacy.
Personal financial information
- You agree to allow Tarrant County to withhold personal financial information regarding an individual, including but not limited to an employee’s benefit election, bank account balance, personal debts and loans, or other information pertaining to an individual’s financial status and past financial history.
- This information may be withheld under Government Code section 552.101 in conjunction with common-law privacy.
- This does not include information about a government employee’s gross salary, which may be released.
Sensitive crime scene images
- You agree to allow Tarrant County to withhold photographs or video recordings taken at a crime scene which depicts a deceased person in a state of dismemberment, decapitation, or similar mutilation or that depicts the deceased person’s genitalia.
- This information may be withheld under Government Code section 552.1085.
Criminal history information
- You agree to allow Tarrant County to withhold an individual’s criminal history compilation or criminal history obtained as a result of a background check obtained from federal, state, or local record information systems.
- This information may be withheld pursuant to Government Code section 552.101 in conjunction with common-law privacy, 28 C.F.R. Part 20, and Government Code chapter 411.
E-mail address of member of the public
- You agree to allow Tarrant County to withhold the e-mail address of a member of the public.
- This information may be withheld pursuant to Government Code section 552.137.
