Delinquent Tax Sales | Can a relative or a friend bid for me? | No, you must be present at the sale, in person, to bid. 34.0445 (b) Civil Practice and Remedies Code reads: An individual may not bid on or purchase the property in the name of any other individual. An officer conducting a sale under this subchapter may not execute a deed in the name of or deliver a deed to any person other than the person who was the successful bidder.34.0445 (e) Civil Practice and Remedies Code reads as: A person who knowingly violates this section commits an offense. Delinquent Tax Sales | If I am the successful bidder, what type of document is issued? | The Constable's Office will issue a document entitled "Constable's Deed to Individual in Delinquent Tax Suits." This deed will then be sent to the attorneys representing the taxing entity. The attorneys will then file the document with the Tarrant County Clerk's Office as soon as possible. |
Delinquent Tax Sales | What form of payment is accepted? | We only accept cash, cashier's check or money order, made payable to Constable Darrell Huffman. We do not accept wire transfers, credit cards, traveler's checks or letters of credit. We also do not have a financing plan. |
Delinquent Tax Sales | What happens to the properties that do not get sold at the auction? | The properties that are struck off at the auction are actually bid on by the taxing entities. The deeds are issued to the property in the name of the taxing entity. The taxing entity then becomes the owner of that property and they can do with the property what they wish. Certain properties are withdrawn from the sale for various reasons. The reasons could range from a defendant filing bankruptcy, the defendant paying off the taxes in full, all the way to technical problems with the order of sale. When these are withdrawn, the attorneys representing the taxing entities then re-advertise them for the following month or remove them from the sale list and the process starts over anew with an application to the court for disposition of the property. |
Delinquent Tax Sales | What newspaper is the sale advertised in? | We use the Fort Worth Commercial Recorder. Their telephone number is 817-926-5351. Their newsstands are located at Tarrant County Courthouses and Subcourthouses. You may also subscribe. This is the most convenient way to get a complete listing of the upcoming sale notices. We do not have a mailing list due to the lack of manpower. The sale notices are published once each week (usually on Tuesday) three weeks prior to the sale. |
Delinquent Tax Sales | When and where are properties listed and sold? | By virtue of Orders of Sale issued out of the Courts in the cause numbers indicated, real properties are to be sold at the Constable's Sale at approximately 10 a.m. in the morning on the first Tuesday of each month. Several of the law firms have their own websites where they maintain lists of properties they are handling. Lists of properties may also be found on the Tarrant County Tax Office's website by clicking the Get Information On tab, then selecting the Delinquent Tax Sales link. The information reflected on the listing is for informational purposes only and may change at any time. These lists include cause numbers, account numbers and attorney's offices. More information may be found on each property by using the account number found on the Delinquent Tax Sales list to search on the Tarrant County Tax Office's Property Tax Account Search page at taxoffice@tarrantcountytx.gov. Physical addresses for the properties can be located this way as well as by searching on the Tarrant Appraisal District's Property Data Search page. All sales are "as is," to the highest bidder on a "buyer beware basis." Any and all questions concerning these properties should be directed to your attorney before the sale. The presence of a property on the tax sale list does not constitute permission to trespass on that property!
